Apr\u00e8s avoir \u00e9t\u00e9 d\u00e9clar\u00e9e injoignable par la mairie et confront\u00e9e \u00e0 une proc\u00e9dure disciplinaire, l\u2019entreprise adjudicataire HAVILLA BDELLIUM ET FILS a finalement r\u00e9affirm\u00e9 son engagement \u00e0 ex\u00e9cuter les travaux. Une volte-face qui intervient apr\u00e8s l\u2019intervention de l\u2019Autorit\u00e9 de R\u00e9gulation des March\u00e9s Publics (ARMP) et une s\u00e9rie d\u2019auditions contradictoires.<\/em><\/strong><\/p>\n\n\n\n<p>Dans un avis rendu le 3 f\u00e9vrier 2025, l\u2019ARMP recommandait \u00e0 la Personne Responsable des March\u00e9s Publics (PRMP) de la mairie de Bohicon d\u2019enclencher la proc\u00e9dure de r\u00e9siliation du contrat sign\u00e9 avec HAVILLA BDELLIUM ET FILS. Selon la secr\u00e9taire ex\u00e9cutive de la mairie, l\u2019entreprise \u00e9tait injoignable depuis l\u2019enregistrement du march\u00e9, ce qui \u00e9quivalait \u00e0 une renonciation tacite \u00e0 l\u2019ex\u00e9cution des travaux. Cependant, au cours de la proc\u00e9dure disciplinaire ouverte par l\u2019ARMP, le g\u00e9rant de l\u2019entreprise a fermement contest\u00e9 cette version des faits. Lors de son audition, il a soutenu que sa soci\u00e9t\u00e9 n\u2019avait jamais renonc\u00e9 au march\u00e9 et qu\u2019elle attendait toujours la remise de site et l\u2019ordre de service pour d\u00e9buter les travaux.<\/p>\n\n\n\n<p>Les auditions des parties impliqu\u00e9es le 21 f\u00e9vrier 2025 ont mis en \u00e9vidence plusieurs dysfonctionnements dans la communication entre la mairie et l\u2019entreprise adjudicataire. Alors que la PRMP de Bohicon soutenait que l\u2019entreprise \u00e9tait rest\u00e9e injoignable, le g\u00e9rant de HAVILLA BDELLIUM ET FILS a affirm\u00e9 ne jamais avoir re\u00e7u d\u2019instructions officielles lui demandant de commencer les travaux. Il a \u00e9galement expliqu\u00e9 qu\u2019il avait d\u00fb voyager \u00e0 l\u2019\u00e9tranger pour des raisons de sant\u00e9, ce qui pourrait justifier son absence temporaire.<\/p>\n\n\n\n<h2 id=\"larmp-tranche-havilla-bdellium-et-fils-pourra-executer-le-marche\" class=\"wp-block-heading\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-red-color\">L\u2019ARMP tranche : HAVILLA BDELLIUM ET FILS pourra ex\u00e9cuter le march\u00e9<\/mark><\/h2>\n\n\n\n<p>Apr\u00e8s instruction du dossier, la commission disciplinaire de l\u2019ARMP a rendu sa d\u00e9cision le 13 mars 2025. Selon nos informations, elle a estim\u00e9 que la pr\u00e9somption de renonciation invoqu\u00e9e par la mairie n\u2019\u00e9tait pas \u00e9tablie, soulignant que la PRMP n\u2019avait pas utilis\u00e9 tous les moyens n\u00e9cessaires pour entrer en contact avec l\u2019entreprise adjudicataire.<\/p>\n\n\n\n<p>Ainsi, la proc\u00e9dure de r\u00e9siliation est abandonn\u00e9e, et HAVILLA BDELLIUM ET FILS conserve le march\u00e9 initialement attribu\u00e9. D&rsquo;apr\u00e8s la d\u00e9cision que La Marina BJ a consult\u00e9e, la PRMP de Bohicon est d\u00e9sormais tenue d\u2019en tirer les cons\u00e9quences et de proc\u00e9der aux formalit\u00e9s administratives en vue du d\u00e9marrage effectif des travaux.<\/p>\n\n\n\n<h2 id=\"un-chantier-enfin-sur-de-bons-rails\" class=\"wp-block-heading\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-red-color\">Un chantier enfin sur de bons rails ?<\/mark><\/h2>\n\n\n\n<p>Avec cette d\u00e9cision, la r\u00e9fection de la balustrade du stade Paulin Tomanaga sera bien r\u00e9alis\u00e9e par l\u2019entreprise initialement retenue, et non par le second soumissionnaire, comme le laissait entendre l\u2019avis du Conseil de r\u00e9gulation de l\u2019ARMP du 3 f\u00e9vrier 2025 (<a href=\"https:\/\/lamarinabj.com\/index.php\/2025\/02\/18\/bohicon-pourquoi-la-refection-de-la-balustrade-du-stade-paulin-tomanaga-na-t-elle-pas-demarre\/\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-green-color\">LMBJ, 18\/02\/2025<\/mark><\/strong><\/a>).<\/p>\n\n\n\n<p>Reste d\u00e9sormais \u00e0 savoir quand les travaux d\u00e9buteront r\u00e9ellement et si l\u2019entreprise respectera cette fois ses engagements.
