Les deux hommes ont comparu \u00e0 nouveau, lundi 20 octobre 2025, devant la chambre d\u2019appel de la Cour de r\u00e9pression des infractions \u00e9conomiques et du terrorisme (CRIET).<\/em><\/strong><\/p>\n\n\n\n<p>Les avocats de la d\u00e9fense, Me Fid\u00e8le Abouta et Me Fran\u00e7ois K\u00e8k\u00e8, ont plaid\u00e9 la r\u00e9vision de la d\u00e9cision d\u2019incomp\u00e9tence rendue en premi\u00e8re instance. Selon eux, la chambre de jugement avait fond\u00e9 sa position sur un extrait unique d\u2019\u00e9changes entre l&rsquo;ex DGPN  et l\u2019ancien ministre Moudja\u00efdou Soumanou, sans autre \u00e9l\u00e9ment mat\u00e9riel de preuve.<\/p>\n\n\n\n<p>Me Abouta a estim\u00e9 que la d\u00e9duction du premier juge assimilant les propos du g\u00e9n\u00e9ral \u00e0 des faits d\u2019assassinat relevait d\u2019une interpr\u00e9tation abusive \u00ab Le \u201cj\u2019\u00e9tais contre\u201d de mon client signifie qu\u2019il s\u2019est toujours oppos\u00e9 \u00e0 toute forme de violence \u00bb, a-t-il pr\u00e9cis\u00e9, selon les \u00e9l\u00e9ments rapport\u00e9s par le journaliste Donald K\u00e9vin Gayet (Banouto). Pour la d\u00e9fense, le dossier rel\u00e8ve de faits purement d\u00e9lictueux \u2014 harc\u00e8lement \u00e9lectronique et incitation \u00e0 la r\u00e9bellion \u2014 et non de crimes, comme l\u2019a retenu le premier juge. Elle a donc demand\u00e9 \u00e0 la Chambre d&rsquo;appel de se d\u00e9clarer comp\u00e9tente.<\/p>\n\n\n\n<h2 id=\"un-mandat-de-depot-juge-irregulier\" class=\"wp-block-heading\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-red-color\">Un mandat de d\u00e9p\u00f4t jug\u00e9 irr\u00e9gulier<\/mark><\/h2>\n\n\n\n<p>De son c\u00f4t\u00e9, Me Fran\u00e7ois K\u00e8k\u00e8 a d\u00e9nonc\u00e9 une irr\u00e9gularit\u00e9 de proc\u00e9dure : le mandat de d\u00e9p\u00f4t \u00e9mis contre l\u2019ex-DGPN aurait \u00e9t\u00e9 sign\u00e9 alors que son client se trouvait encore \u00e0 la Brigade criminelle. \u00ab Le faux corrompt tout, c\u2019est \u00e9l\u00e9mentaire en droit \u00bb, a-t-il lanc\u00e9, demandant l\u2019annulation du mandat et la lib\u00e9ration imm\u00e9diate de son client.<\/p>\n\n\n\n<p>Le minist\u00e8re public a, pour sa part, maintenu ses r\u00e9quisitions : deux ans de prison ferme et cinq millions de francs CFA d\u2019amende contre le g\u00e9n\u00e9ral, ainsi qu\u2019une relaxe au b\u00e9n\u00e9fice du doute pour son neveu. Apr\u00e8s les d\u00e9bats, la Chambre d&rsquo;appel de la CRIET a mis l\u2019affaire en d\u00e9lib\u00e9r\u00e9 au 1er d\u00e9cembre 2025.
